In the field of family law the notary above all helps with marriage contracts and agreements regulating the legal consequences of divorce. He explains to the client for which cases a marriage contract makes sense and for which motives of the client such a contract is not required. After thoroughly advising both spouses he names the legal provisions, the variants and modifications advisable for his clients and their marriage model and points out the limits set by laws and the courts to freedom of contract. The notary makes it a rule to point out appropriate accompanying measures such as full powers of attorney and powers of attorney for health care and succession declarations. For concrete divorce cases he draws up documents which shorten stressful and time-consuming divorce proceedings and reduce the costs of these. At the same time the notary thinks of succession declarations here too.
Furthermore, the notary's assistance is required for parents and child matters (acknowledgements of paternity and adoptions). |
